A woman who suffered lasting physical and emotional trauma from ruptured breast implants has been awarded £250,000 in damages by the High Court, following a medical negligence claim against the cosmetic surgeon involved in her procedure.
The 36-year-old, who cannot be named for legal reasons, described the impact of the ordeal, stating, “My life has been hell for the last 15 years trying to fix this mess.”
The woman, a mother from west Belfast, underwent breast augmentation surgery at a private clinic near Birmingham in 2009. According to her legal team, the implants were improperly sized, which led to ruptures and infections in the subsequent years. Although the implants were removed two years later, she continued to experience complications, requiring several corrective surgeries between 2012 and 2022. Eventually, she sought out new implants in Turkey, feeling dissatisfied with previous attempts at repair.
The court heard from medical experts who testified to the severe scarring on both breasts and a psychiatric adjustment disorder believed to have developed as a result of the botched procedure.
Legal action was initially taken against a private healthcare firm, but after the company went into administration, the claim was pursued directly against Dr. Marcos Sforza, the London-based surgeon who performed the surgery. The woman’s solicitor, Brian Archer, confirmed that she had previously obtained a judgment after the defendant failed to enter a defense.
At a subsequent hearing to determine the level of compensation, the plaintiff provided testimony about how her life had been affected by the surgery. Based on this evidence and supporting medical reports, the court awarded her £250,000 in damages.
Reflecting on her experience, the woman said, “I was so young, the implants were too big, there was infection, and for two years [after the implants were removed], I had no tissue there. My confidence has been knocked so much. I’ve been trying to fix this for years.” She also shared the personal toll the ordeal had taken on her relationships, including her partner and her relationship with her son, saying, “Even when I took my son swimming, I didn’t want to wear a bikini.”
After researching options and reaching out to an English model and celebrity, the woman chose to undergo further surgery in Turkey two years ago. “There’s still some scarring, but they were the only ones who made me feel that I could live with this,” she said.
The ruling highlights the serious consequences of botched cosmetic surgery and the legal recourse available for those affected by medical negligence.
